1. Your Chosen Package:
The session duration and final products are limited to the purchased package.

2. Payment Terms:
The total invoiced amount (including GST) is, calculated according to our Standard Price List. This amount must be paid before we kick off the services – it's the only thing that stands between us and the fun photo session! If, for any reason, you need a refund, it will be processed within 1 month of cancellation, and it will be sent via the original payment method (Bank Deposit or PayPal).

3. Consent to Photograph:
You give Pixel Pets full permission to photograph your beloved pet and use the resulting pictures as described in this agreement.

4. Use of the Photographs by Pixel Pets:
Here's the scoop on the photographs – Pixel Pets retains full ownership and copyright of all images taken during our photography session. We are super proud of our work and have exclusive rights to use and reproduce the photographs for various purposes, including displaying them on our website, social media, third-party websites or blogs, advertising, promotional materials, online marketing, and inclusion in my portfolio. Don't worry we won't forget about you! You'll receive the final images for your personal use only – they're meant to bring joy to your heart and preserve beautiful memories. But remember, copyright laws protect these images so please don't edit, alter, or manipulate them without Pixel Pets explicit written permission.

5. Intellectual Property:
As Pixel Pets, I value my work and all copyright and other intellectual property rights in the photographs belong solely to Pixel Pets. Our rights extend to our successors, legal representatives, and assigns. You are not to use the photos for profit, sale, marketing or business by yourself or any other party without our explicit written permission by Pixel Pets.

6. Your Responsibilities:
We want to make sure we capture your pet in the best light possible! To help us with that, please disclose all the necessary information about your pet, including health conditions, dietary restrictions, and any behavioural issues. During the session, it's crucial to keep your pet under control. While we ensure a safe environment, you're ultimately responsible for everyone's well-being.

7. Pet Behaviour:
Working with animals is a unique experience, and sometimes pets can be a little unpredictable – it's part of what makes them so lovable! But if for some reason your pet is uncooperative during the session don't worry, we'll promptly communicate with you to reschedule the session to a mutually agreeable date and time.

8. Rescheduling and Cancellations:
We understand that life can get busy, so if you need to reschedule or cancel, please let Pixel Pets know in writing at least 48 hours before the scheduled Photo Session Date. We'll do our best to accommodate your request, but keep in mind that we're not obligated to reschedule. If you do need to reschedule, we'll aim to arrange it within 3 months of the original appointment. Late attendance may impact the session duration, and we won't be able to extend the photo session beyond the booked time frame. If, for any reason, you don't attend the Photo Session with no or late notice, the payment will be retained by Pixel Pets.

9. Services and Responsibilities:
Once your payment is received, we'll provide the Services you've purchased. We'll do our best to deliver the edited digital photographs within 2-4 weeks from %job_date% – but remember, timeframes are just estimates. After we deliver the final photos via a third-party online gallery, they'll be available for at least 12 months. If you have any changes you'd like to make to the services, just let us know in writing, and we'll work together to accommodate your requests.

10. Liability and Limitations:
Pixel Pets will always aim to provide you with top-notch service but if there's an issue just notify us within 24 hours after the Completion of the Services and we'll do our best to fix it or offer a refund. We also want to give you a heads-up that Pixel Pets might provide access to a third-party online platform which will be subject to their own terms and conditions.

11. Delivered Services and Products:
Pixel Pets want you to be thrilled with our services and products! In compliance with the Australian Consumer Law, we guarantee that the delivered services and products will be fit for their disclosed purpose, of acceptable quality, and free from defects. You have the right to inspect the delivered services and products and notify us of any non-compliance with the ACL within 7 days. If there's any issue we'll promptly address it.

12. Termination:
We hope it never comes to this, but if there's a breach of this agreement, failure to reschedule, or circumstances preventing us from providing the services, we may have to terminate the agreement. Also, if Pixel Pets believes that you or your pet's health may be at risk we may use our discretion to terminate the agreement. In the unlikely event that Pixel Pets is unable to perform our service due to our own circumstances, we'll offer a full refund or reschedule.

13. Release and Indemnity:
Pixel Pets understands the joy of working with pets but we also acknowledge that there might be some unpredictable moments. By accepting this agreement, you agree to release and hold harmless Pixel Pets, our contractors, agents, and employees from any liability, claims, demands, or legal proceedings arising from your or your pet's participation in the photography session or the use of the photographs. Rest assured, we'll do our best to ensure everyone's safety and happiness!

14. Warranties:
You confirm that by signing this agreement and fulfilling your obligations under it, you won't violate any rights or obligations of third parties. Also, you won't seek payment or claim any rights (including copyright or intellectual property rights) in the photographs. We want you to enjoy the memories without any worries and this agreement helps us ensure that!

15. General:
Let's resolve any issues through friendly discussions before resorting to legal action – we're all about positivity here! Any confidential information shared will be kept private. If we need to send notices, let's make sure they're in writing and sent to the provided addresses. This agreement doesn't create a partnership or agency relationship between us. If any provision is invalid, we'll adjust or remove it while keeping the rest valid. This agreement represents our entire understanding and can only be amended in writing. Oh, and it's all governed by the laws of Western Australia and the Commonwealth of Australia.
